1. Scope and Additional Policies

These Terms apply to all visitors, customers, users, and others who access or use the Services.

Our posted Privacy Policy, Refund Policy, Shipping Policy, Return Policy, Subscription Policy, promotional terms, or other policies and notices that are expressly incorporated into these Terms form part of these Terms to the extent applicable. By submitting User Content, you grant ARIH and its affiliates, partners, promoters, and agents a non-exclusive, worldwide, irrevocable, perpetual, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, repost, modify, adapt, publish, translate, distribute, display, and otherwise use that User Content on the Site or elsewhere in connection with operating, marketing, improving, and promoting the Services and our business, subject to applicable law and our Privacy Policy. To the maximum extent permitted by applicable law, you also waive any moral rights or other similar rights you may have in such User Content.

We may, but are not obligated to, monitor, review, remove, edit, or refuse any User Content at any time.

If you provide feedback or suggestions about the Services, you agree that we may use them without restriction or compensation to you.

Except as expressly permitted in writing by us, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, transmit, scrape, mine, reverse engineer, frame, or otherwise exploit any portion of the Services.

All trademarks, service marks, trade names, logos, and brand elements displayed through the Services are the property of ARIH or their respective owners. Nothing in these Terms grants you any right or license to use them without prior written permission. All rights not expressly granted to you in these Terms are reserved by ARIH and its licensors.

9. Copyright Infringement Claims

If you believe that any content available through the Services infringes your intellectual property rights, you may submit a notice to ARIH’s designated agent in accordance with the Digital Millennium Copyright Act (17 U.S.C. §512). You may submit a notice to ARIH’s designated DMCA agent (identified in the Contact Information section below).

10. Third-Party Services and Links

The Services may include links to third-party websites, applications, tools, content, social media platforms, payment processors, or other services that we do not own or control.

We are not responsible for the availability, content, accuracy, privacy practices, security, or terms of any third-party services. Your interactions with third-party services are governed by those third parties' own terms and policies. The inclusion of any third-party link or service does not imply ARIH's endorsement, approval, or recommendation of the applicable third party or its offerings.

11. Prohibited Conduct

You may NOT:

• Use the Services in violation of any law, regulation, or third-party right.
• Engage in fraud, abuse, deception, or other harmful conduct.
• Upload, transmit, or distribute viruses, malware, or other malicious code.
• Interfere with, disrupt, damage, or circumvent the security or operation of the Services or any related systems.
• Use any robot, spider, scraper, crawler, data-mining tool, or similar automated means except as permitted by applicable law and our written authorization.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Collect or attempt to collect personal information of others without proper authority.
• Use the Services in any way that could harm ARIH, our customers, our service providers, or the public.
• Engage in any activity that is inconsistent with the intended purpose of the Services or that otherwise violates these Terms.
• Resell any products purchased through the Services; such products are for personal use only and may not be resold, redistributed, or used for commercial purposes without ARIH’s prior written consent.
• Use the Services or any content obtained from the Services for the purpose of developing, promoting, or marketing competing products or services, or for unauthorized commercial exploitation.
• Use, reproduce, distribute, or otherwise exploit the name, image, likeness, voice, signature, or other indicia of identity of ARIH, its founders, affiliates, influencers, celebrities, or partners, whether in connection with advertising, endorsements, promotions, or otherwise, without prior written consent. Any such unauthorized use may violate rights of publicity, trademark laws, and other applicable laws.

12. Privacy

Your submission of personal information through the Services is governed by our Privacy Policy. Please review it carefully to understand how we collect, use, disclose, and otherwise process personal information.

13. Food and Allergen Disclaimer

Products made available through the Services may contain or come into contact with allergens. ARIH does not guarantee that any product is free from allergens or safe for individuals with food allergies or sensitivities. You are solely responsible for reviewing product information and ingredient disclosures and determining whether a product is appropriate for your consumption.

14. Product Recalls and Safety Notices

ARIH reserves the right to issue product recalls or safety notices at any time. You agree to comply with any recall or safety-related instructions, including ceasing use of affected products and following return or disposal instructions where applicable.

15. No Reliance

You acknowledge and agree that, in entering into these Terms and using the Services, you have not relied on, and expressly disclaim reliance upon, any representations, warranties, statements, or assurances of any kind, whether oral, written, implied, or arising from course of dealing, usage, or trade, except as expressly set forth in these Terms or as required under applicable law.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL PRODUCTS, CONTENT, AND MATERIALS MADE AVAILABLE THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARIH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARIH AND ITS AFFILIATES, PARENTS, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF ARIH AND THE OTHER PARTIES IDENTIFIED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE RELEVANT PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

THE LIMITATIONS OF LIABILITY SET FORTH IN THESE TERMS ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND ARIH.

18. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ARIH and its affiliates, parents, subsidiaries, officers, directors, employees, agents, licensors, service providers, and contractors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Services, or your violation of any law or third-party right. ARIH reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in that event, you agree to cooperate fully with ARIH in asserting any available defenses.

19. Termination

These Terms remain in effect until terminated by you or us.

We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, pose a risk to ARIH or others, or if we discontinue the Services.

The obligations and liabilities of the parties that by their nature should survive termination will survive, including, without limitation, provisions relating to intellectual property, User Content licenses, disclaimers of warranties, limitation of liability, indemnification, dispute resolution, governing law, and any payment obligations. Termination of these Terms or your access to the Services will not limit any of our rights or remedies at law or in equity.

20. No Endorsement

Your use of the Services does not create, and shall not be deemed to create, any partnership, joint venture, employment, or agency relationship between you and ARIH. You may not represent, imply, or suggest that you are affiliated with, endorsed by, sponsored by, or acting on behalf of ARIH or any of its affiliates, founders, influencers, celebrities, or partners without ARIH’s prior written consent. Any unauthorized representation may result in suspension or termination of your access to the Services.

21. Governing Law and Forum; No Other Jurisdiction

These Terms and any dispute arising out of or relating to these Terms or the Services will be governed by the laws of the State of California, without regard to its conflict of laws principles.

Except as otherwise provided in Section 23 (Dispute Resolution), the state and federal courts located in Orange County, California will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to the personal jurisdiction of those courts.

ARIH makes no representation that the Services are appropriate or available for use outside the United States, and access from jurisdictions where the Services are illegal is prohibited.

22. Force Majeure

ARIH will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, severe weather, labor disputes, supply chain disruptions, pandemics, governmental actions, utility failures, telecommunications failures, cyber incidents, transportation interruptions, or carrier delays.

23. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall take place in Orange County, California, unless otherwise required by applicable law. You and ARIH agree that arbitration shall be conducted on an individual basis only and not as a class, consolidated, or representative action. YOU AND ARIH EACH WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

24. Miscellaneous

These Terms constitute the entire agreement between you and ARIH regarding the Services, except to the extent that additional terms expressly apply.

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets, or by operation of law.

These Terms do not confer any rights or remedies upon any person or entity other than you and ARIH, except as otherwise expressly provided herein.

Section headings are for convenience only and have no legal or contractual effect.

By using the Services, or by sending emails, messages, or other communications to us through the Services, you consent to receive communications from us electronically, including notices, disclosures, agreements, and other communications. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

25. Changes to These Terms; Qualified Privilege

We may update these Terms from time to time. If we make material changes, we will post the updated Terms through the Services and update the Last Updated date above. Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically for updates.

As long as you comply with these Terms, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

26. Non-Waivable Rights

Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under applicable law that cannot lawfully be excluded, restricted, or modified.
